VIC:Police find body in Yarra River
MELBOURNE, Aug 14 AAP - Police divers have found the body of a 23-year-old man who
tried to swim across Melbourne's Yarra River on Saturday night.
The man had been out for a night with friends when he jumped into the river near Federation
Square in inner-Melbourne about 10pm (AEST).
Witnesses have told police he was about 10 metres from the bank when he got into difficulty
and disappeared.
Divers found his body about 2.15am today.

OVER EMERALD, Dec 31 AAP - Queensland Premier Anna Bligh says there is a flood crisis
in Emerald with the army evacuating people and building makeshift emergency accommodation
outside the town.
The Nogoa River is at 16 metres and rising and more than 1200 residents have registered
as evacuees, with more than 500 put up in evacuation centres.
Ms Bligh says more evacuations are expected.
"Authorities think there will be a very large group of people who will be homeless
in the next 24 hours," she told reporters who went with her on a flood tour on Friday.
The defence force has been called in to set up emergency accommodation outside Emerald,
and two Black Hawk helicopters are flying locals out and making food drops to isolated
communities around the town.
Ms Bligh and Prime Minister Julia Gillard planned to visit the town on Friday but the
emergency evacuations and a shortage of aviation fuel forced a change of plan.
Instead the premier's plane flew over the town.
The dirty tide has spared little, with Emerald now an island in an inland sea.
Water is lapping at the windows of scores of homes and nearby cane and citrus farms
are submerged.
The Fairbairn Dam is holding back an immense body of water - it's now at 175 per cent
capacity with 5.6 metres of water pouring over the spillway, well beyond the 4.4 metres
recorded during the 2008 flood.
Central Highlands Mayor Peter Maguire said authorities were still trying to determine
how many homes and businesses had been flooded.
"It's not an easy task," he said. "We haven't got a real feel for how many homes have
been evacuated."
Mr Maguire said the flood should peak some time on Friday afternoon and efforts were
underway to resupply the town and outlying communities.
Earlier, Red Cross Queensland executive director Greg Goebel said floodwater had swamped
up to 80 per cent of the town.
Before flying over Emerald, Ms Bligh and the prime minister visited flood-ravaged Bundaberg.
They walked along the edge of the receding Burnett River. Behind them a row of cottages
had water up to their window sills.
One of the homes is owned by Cheryl McDowell who, after 20 years, paid off her mortgage
just two weeks ago.
Insurance companies had refused to insure any of the homes, or others in the postcode
bordering the river, but her spirits were up despite the disaster.
"As long as we've got our lives," Ms McDowell told reporters.
Her 72-year-old neighbour is in hospital in Brisbane undergoing surgery and is yet
to be told of the devastation.
Ms Bligh said she was pleased the Burnett River was starting to recede.
But she said it would be some time before Queensland could enter full recovery mode
after the state's worst floods in recorded history.

Opposition Leader TONY ABBOTT has squeezed a beer .. an Asian buffet .. a spot of tennis
and a meeting with local coppers into six hours of campaigning in Sydney overnight.
But he has admitted to taking a cat nap.
The opposition leader is well into his 36-hour shift of non-stop campaigning .. which
has taken him from marginal seats in Queensland to those in New South Wales.
At about 1am (AEST) this morning Mr ABBOTT travelled to Campbelltown in south-west
of Sydney for a round-table discussion with police officers.
Commenting on the latest polls which have the big parties in a neck-and-neck battle
.. Mr ABBOTT said the election remains extremely tight.
Mr ABBOTT plans a blitz of the radio airwaves early this morning.

Three foreign sailors who allegedly steered a bulk carrier into restricted waters around
the Great Barrier Reef have been granted bail in Townsville.
GANG CHUN HAN .. the South Korean master of the Panama-flagged MV Mimosa .. has faced
the Townsville Magistrates Court today .. charged with offences under the Great Barrier
Reef Marine Park Act.
Two officers .. TRAN TAN THANH and NGUYEN VAN SANG .. aged 32 and 26 and both from
Vietnam .. have also faced court on charges under the Act.
They've been granted bail .. to reappear on Friday.
It's alleged the Mimosa ventured off course in the marine park on April 4 .. and didn't
respond to attempts by Australian authorities to contact them.

FED: A first for women - leading government and the opposition
PERTH, Aug 10 AAP - For the first time in Australia, women are occupying the top spots
in both government and opposition.
While Prime Minister Kevin Rudd is in Beijing for the Olympic Games and Opposition
Leader Brendan Nelson is visiting the United States, Julia Gillard is acting prime minister
and Julie Bishop is acting opposition leader.
It is not the first time Ms Gillard has been the acting prime minister, and by default,
not the first time a woman has been in charge of the country.
But it is the first time Ms Bishop has had the acting coalition leader's job and she
said it was the first time a woman had the job.
"As deputy leader it's the first time we've had a West Australian in the (federal)
leadership team," Ms Bishop told AAP.
"It's the first time there's been a woman in the leadership team, so it follows that
it's the first time that we've had a West Australian and woman as the acting leader of
the opposition."
Ms Bishop said the situation had only dawned on her on this morning.
"I saw her (Ms Gillard) on ABC Insiders this morning as acting prime minister, and
I was about to come out and do a doorstop as acting leader of the opposition, and I thought
well ... girl power."

NSW: Bank employee accused of $2 million fraud
SYDNEY, April 1 AAP - An employee accused of defrauding a bank of $2 million will face
court in Sydney later this month.
The 36-year-old South Hurstville man allegedly transferred the money into a fake account
over an 11-year period.
Police, who have refused to name the bank, said he attached a large line of credit
to the account before buying a luxury property at Sandringham in Sydney's south.
It's also alleged the man created a line of credit for a relative, without paperwork
or security, the day before he left his job at the bank.
The man was arrested yesterday and charged with obtaining money by deception.
He was bailed to appear at Downing Centre Local Court on April 21.

Fed: PM rules out 2008 election
JOHN HOWARD has ruled out the possibility of an election next year.
The prime minister's told ABC Radio he hasn't decided when to hold the federal election
.. but it won't be next year.
Under Commonwealth law .. the election must be held by next January 19 .. and must
be called between 23 and 31 days before the nominated date.
Mr HOWARD has also once again denied he's considering retiring .. and says as long
as his party wants him .. and it's in its best interest .. then he'll stay on.

The head of the organisation running the Melbourne aged nursing home Broughton Hall
.. where four people died over the Easter break .. has denied there was an outbreak of
food poisoning there.
Benetas chief executive SHARON CALLISTER says it wasn't food poisoning .. but gastroenteritis
which struck the nursing home patients.
The denial comes despite one of the victims being diagnosed with salmonella in hospital
.. and a Department of Human Services statement on Saturday saying the deaths were a result
of food poisoning.
Victoria's Opposition has called on state Health Minister BRONWYN PIKE to resign ..
saying she must accept responsibility for the debacle.
Workplace Combet (CANBERRA)
ACTU boss GREG COMBET has dismissed government claims unions will spend 70 million
dollars attacking Work Choices ahead of the next election .. as absurd.
Workplace Relations Minister JOE HOCKEY says Labor and the unions plan to spend 100
million on their anti-Work Choices campaign .. with two-thirds of the money coming from
unions.
Mr COMBET's told ABC radio that's ridiculous .. and the ACTU doesn't have anywhere
near that sort of money.
He won't say how much is in the kitty .. but for the last two years the ACTU's levied
each union member five dollars 50 a year .. to fight the federal government's workplace
laws.
Malu (BRISBANE)
An inquest into the death of five people on board an Immigration Department boat ..
in the Torres Strait in far north Queensland .. will resume on Thursday Island today.
The Malu Sara .. which has never been found .. was carrying two immigration agents
and three locals .. when it sank on its 74 kilometre journey from Saibai Island to Badu
Island on October 15 2005.
It was one of six boats purpose-built for the then Immigration Multicultural and Indigenous
Affairs Department .. and was issued a seaworthy notice just one month before the tragedy.
Barnett (MELBOURNE)
An artist who planted a fake bomb outside the National Gallery of Victoria will spend
three months behind bars.
46-year-old COLIN DOUGLAS BARNETT of Cranbourne North had earlier pleaded guilty in
the Victorian County Court to creating a bomb hoax .. causing a public nuisance .. and
making a false report to police.
He'd admitted placing a clay vase-shaped sculpture .. which he called a peace bomb
.. outside the gallery .. and alerting police to a suspicious package.
Judge LEO HART says it's a "bizarre" case .. and BARNETT had the dual aim of getting
recognition for his work and sending an anti-terrorism message.
He's jailed BARNETT for 15 months .. with 12 months suspended for 15 months .. and
ordered him to pay more than six thousand dollars in compensation to police who had to
close part of busy St Kilda Road during the operation.

Qld: Policeman in hospital after car crash
BRISBANE, Dec 14 AAP - An officer is in hospital after a police car crashed into a
tree on Brisbane's bayside.
Police said initial investigations indicated the male driver of an unmarked police
car had attempted to intercept another vehicle at Hemmant about 7.10am (AEST) today.
Instead, the police car crashed into a tree near the intersection of Gross Avenue and
Hemmant and Tingalpa roads.
A spokeswoman said it was not known why the other car was being intercepted or whether
it played a role in the accident.
The constable received minor injuries while his passenger, a male senior constable,
had to be cut from the wreckage.
He was taken to the Princess Alexandra Hospital with pelvic and rib injuries.
The Accident Investigation Squad and Ethical Standards Command are investigating the accident.

Tas: Woman driver killed in two-car collision in NE Tasmania
An elderly woman has been killed after her vehicle and another car collided in north-eastern
Tasmania.
Police say the woman in her 80s died in the two car smash just after midday (AEST)
on the Tasman Highway near Scamander .. about 100 kilometres east of Launceston.
Two people travelling in the second car escaped injury.
The highway has been closed between Elephant Pass and the intersection of St Marys
Pass and Tasman Highway.

NSW: Female officer punched in the face
SYDNEY, April 1 AAP - A female NSW police officer had to be treated in hospital for
injuries after she was punched in the face and knocked to the ground by a man.
The officer was part of a group of police called to a Health facility in Blackbutt,
on the NSW south coast, to assist staff with a troublesome male patient at about 4.10pm
(AEDT) yesterday.
As they arrived, police became involved in a struggle with the patient in which the
policewoman was punched in the face and knocked to the ground by the man.
The officer was taken to Shellharbour Hospital where she was treated for a substantial
injury to her mouth, a police spokeswoman said.

FED: Unions hit the airwaves in latest round of IR fight
SYDNEY, Aug 1 AAP - Unions have hit the airwaves in the latest round of their fight
against the federal government's workplace reform.
A breakfast radio program, run by various trade unions and backed by Unions NSW, was
launched today on FM 88.9 and will run from 5.30am until 9am on weekdays.
Workers Radio Sydney announcer Craig Bulley said the program would inform workers about
what the planned industrial relations changes meant for them.
On Friday, the ACTU and Federal Labor lost a High Court quest for an interim injunction
to have the government's $20-million advertising campaign promoting IR reform taken off
air.
The case will now go before the High Court's full bench, after Justice Dyson Heydon
granted an order for an expeditious hearing.

Mr Costello was asked whether BHP Billiton or Rio Tinto would be subject to foreign
investment review requirements if they decided to make rival bids for WMC.
He said it was likely they would have to go through the same process as Xstrata if
they were deemed to be foreign.
"If they were deemed to be foreign corporations they might," he said.
"They would have to apply and it would have to be considered on its own merits."
Mr Costello said that, if Xstrata breached any of the conditions, the approval of its
bid could be declared void and they could be forced to divest WMC.
"We will use all of the powers that are available if you breach a condition of approval
in Australia and you will be subject to divestment," he said.

TRA's Fiber-To-The-Home project to boost IT service.
MUSCAT: The Telecommunications Regulatory Authority (TRA) approved the Fiber-To-The-Home (FTTH) pilot project in the Sultanate, which involves connecting high-speed Internet to homes in Ma'bailah North and Ma'bailah South, along with other telecom services according to the selection of operators.
This pilot project extends for a period of nine months from the start of the project and implemented by the two licensed operators, Omantel and Nawras.
The aim of this pilot project is to test the technical feasibility of the fiber-optic infrastructure (FTTH), where the government has already allocated a budget for building a fiber-to-the-home network (FTTH) as part of Muscat Wastewater Project implemented by Haya Water Company.
Through piloting the Fiber-To-The-Home (FTTH) project Omantel and Nawras will select users who will try this technology in Ma'bailah North and Ma'bailah South up to a maximum of 400 buildings. The selected users will be provided free high speed internet through fiber optic technology during the trial period to test the service and ensure its stability.
TRA considers this project as one of the most important projects that may contribute to the future increase of the spread of broadband services in the Sultanate.
The participants in this pilot project are expected to send their feedback on their actual experience as it is important to reach accurate findings by the TRA, operators and Haya Water.

GRANBY POLICE CAPTAIN CHARGED WITH POSSESSING CHILD PORNOGRAPHY.
NEW HAVEN, CT -- The following information was released by the United States Attorney's Office for the District of Connecticut:
David B. Fein, United States Attorney for the District of Connecticut, and Colonel Danny R. Stebbins of the Connecticut State Police announced that DAVID L. BOURQUE, 50, of West Suffield, was arrested today on a federal criminal complaint charging him with possession of child pornography. BOURQUE is a captain with the Granby Police Department.
The criminal complaint alleges that, on two occasions in March 2011, a Connecticut State Police trooper assigned to the Connecticut State Police Computer Crimes Unit, acting in an undercover capacity, logged into a publicly available Internet file sharing program and downloaded several images of suspected child pornography from an account maintained by BOURQUE. On April 11, 2011, members of the Connecticut State Police were given consent to search BOURQUE's office and work computers at the Granby Police Department. The search of BOURQUE's office revealed a laptop and other computer components, including an external hard drive, that were personally owned by BOURQUE. These items, most of which were encrypted, were seized pursuant to a state search warrant. The State Police also executed a state search warrant at BOURQUE's residence.
Preliminary analysis of one of BOURQUE's encrypted hard drives has revealed thousands of images and videos of child pornography.
Today, BOURQUE surrendered to law enforcement and appeared before United States Magistrate Judge Thomas P. Smith in Hartford. After signing a $150,000 non-surety bond, which was cosigned by his wife, BOURQUE was directed by Judge Smith to return to a hospital where he has recently been receiving medical care. Following his health care treatment, BOURQUE will be subject to several conditions of release, including that he receive mental health counseling, have no internet access, have no unsupervised contact with children under the age of 18 without first receiving permission from the United States Probation Office, and that he not hold any position of authority or guidance over children or youth groups involving children who are under the age of 18. BOURQUE also must not loiter around schools, playgrounds, arcades, or any other places where children under 18 congregate.
If convicted of the charge of possession of child pornography, BOURQUE faces a maximum term of imprisonment of 10 years and a fine of up to $250,000.
U.S. Attorney Fein stressed that a complaint is only a charge and is not evidence of guilt. Charges are only allegations, and the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt.
This case is being investigated by the Connecticut State Police Computer Crimes Unit, the Federal Bureau of Investigation and the Connecticut Computer Crimes Task Force, which includes federal, state and local law enforcement agencies. The case is being prosecuted by Assistant United States Attorney Ray Miller.

A TODDLER killed by the family rottweiler was snatched from the arms of his seven-year-old aunt and savaged in front of the horrified youngster.
The 10-stone dog pounced on Archie-Lee Hirst, tearing him from the little girl before mauling him to death in the backyard of his grandmother's terraced home.
As the horror unfolded, his young aunt raced upstairs screaming to her 16-year-old sister Kara for help.
Kara ran downstairs and desperately tried to fight off the huge dog before calling police on her mobile.
But it was too late to save her little nephew.
Police have praised Kara's brave attempts to save him.
Last night the toddler's distraught parents - Becki Hirst, 17, and Damian Williamson, 20 - were being comforted by family and specially-trained police officers.
In her own internet page, Becki had revealed she "didn't know what she'd do" if she ever lost "gorgeous" Archie-Lee, who had just enjoyed his first proper Christmas.
She wrote the comments on a web page devoted to her son, and plastered with photos of the smiling tot.
Proud Mum Becki said: "I love it when he does his giggle - makes me happy to know he is smiling. I don't know what I'd do if I didn't have him."
Archie-Lee had been staying at his grandmother Sharon Hirst's home in Wakefield, West Yorks, when the family pet went berserk on Friday afternoon.
His mother and grandmother were visiting friends nearby.
The animal had gone for Archie-Lee as his seven-year-old aunt carried him outside so she could give it a stroke. As she entered the backyard, the immensely powerful beast struck, dragging Archie-Lee to the floor and inflicting horrific injuries within minutes.
The two-and-a-half-year-old rottweiler bitch refused to let go despite being hit repeatedly by Kara who then dashed from the house and dialled 999 on her mobile.
An ambulanceman who arrived within six minutes scaled a 7ft fence to reach the boy and administer first aid while the dog snarled in a corner of the yard.
Archie-Lee was taken to hospital but died five hours later. A post mortem revealed he died from multiple injuries consistent with a dog attack.
Police revealed that Archie-Lee's seven-year-old aunt and her six-year-old sister, who was also in the house at the time, hid in a bedroom as the dog prowled the yard after the attack.
Neighbours said yesterday the dog was not killed until two hours after the attack. Andy Foster, who witnessed the dog's last moments, said: "Police dog handlers were trying to calm it down and catch it with loops, but it was absolutely ferocious and jumping at the fence.
"It went on for about two hours - then we heard the shot and the dog stopped barking."
He added: "The dog was vicious and my three-year-old son was terrified of it and wouldn't go past it to the park."
Although they had split, Archie-Lee's mum Becki is in regular contact with the little boy's dad Damian.
Damian's brother Ryan Williamson, 18, said last night: "Damian and Becki are both beside themselves with grief.
"They are together at the moment sharing their grief and trying to cope with what has happened.
"They had been together for a couple of years and had their ups and downs but they both loved Archie-Lee and worshipped the ground he stood on. It's like a bad nightmare. We had no reason to believe the dog was dangerous."
Detective Superintendent Steve Payne, who is leading the investigation, said the family had owned the dog for just six months.
"It is not a dangerous dog by Dangerous Dog Act definition, and lots of families have similar dogs that don't cause any problems."
He added: "I have to pay tribute to the young auntie, who attempted to rescue the child.
"She did try her best to recover Archie from the dog, but unfortunately that was in but vain. It is a full-size rottweiler and we're talking about a powerful dog here.
"Clearly the death of any young child is a tragedy, but this wasn't expected ... it is nobody's fault."
Several breeds of dog deemed to be dangerous have been banned by Parliament, but not rottweilers.
The controversial Dangerous Dogs Act was introduced in 1991 and banned Pit Bull Terriers - the breed which attacked and killed five-year-old Ellie Lawrenson last January in Liverpool.
