ALBANY ---- A state appeals court has tossed a lawsuit that accused the Ballston Spa Central School District of failing to safeguard a fifth-grader during a touch football game.
The student at Wood Road Intermediate School lost three teeth and fractured another during a "one-hand" touch football game during recess. The girl and a teammate had been running toward the same opponent when the child's mouth and the teammate's head collided, the decision stated.
The injured girl's mother, Lenore Bellinger, sued the school district, alleging negligent supervision of her child, identified as Raven Simmons.
